Terms and Conditions

§ 1 Scope

These General Terms and Conditions (GTC) apply to all orders placed through the erdkinder online shop (erdkiner.shop) by consumers and businesses. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

§ 2 Contracting Party, Conclusion of Contract

The purchase contract is concluded with erdkinder, Florian Kuhlert. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. By clicking on "Buy" or "Order with obligation to pay", you submit a binding offer. We accept the offer by sending an order confirmation via email or by shipping the goods.

§ 3 Production and Delivery Time

The production time for our shirts is generally 2–5 business days. The designs shown are fixed motifs and are not custom-made; the statutory right of withdrawal therefore remains valid (see withdrawal policy).

§ 4 Prices, Shipping Costs

All prices are in euros, including statutory value-added tax [or without VAT according to § 19 UStG]. Additionally, shipping costs will apply, which will be displayed to you in the order process before you submit your order. Details under Shipping & Returns.

§ 5 Payment

Payment can be made by credit card, PayPal, Klarna, Apple Pay, Google Pay, or instant transfer . The purchase price is due upon conclusion of the contract.

§ 6 Delivery

Delivery is available within Germany and to the EU and worldwide under specific circumstances. The estimated delivery time results from production time plus shipping time and is indicated on the product page. In case of unavailability, we will inform you immediately and refund any payments already made.

§ 7 Retention of Title

The goods remain our property until full payment has been received.

§ 8 Warranty

The statutory liability for defects applies. Slight color deviations between screen display and print are technically unavoidable and do not constitute a defect.

§ 9 Right of Withdrawal

Consumers are entitled to a right of withdrawal in accordance with the withdrawal policy.

§ 10 Copyright

All designs are protected by copyright. By purchasing a shirt, you do not acquire any usage rights to the motifs.

§ 11 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as the protection afforded by mandatory provisions of the law of the state of residence is not withdrawn. The contract language is German. The EU Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr.
